UNPAID LEAVE (Labour Code)

Academic teachers and employees who are not academic teachers

At the written request of the employee, unpaid leave may be granted - Article 174 of the Labour Code

The period of unpaid leave shall not be included in the period of work on which the employee's rights depend. When granting unpaid leave, longer than 3 months, the parties may provide for the admissibility of the employee's dismissal from the leave for important reasons.

With the employee's consent, expressed in writing, the employer may grant the employee unpaid leave to perform work for another employer for a period determined in an agreement between the employers on the matter (art.1741 of Labour Code)

Those taking unpaid leave for more than one month should insure themselves in accordance with the provisions of the Act of 13 October 1998 on the social insurance system (i.e. Journal of Laws of 2016, item 963 as amended) and the Act of 27 August 2004 on health care services financed from public funds (i.e. Journal of Laws of 2016, item 1793 as amended).
